2. SCOPE
These General Terms and Conditions of Sale (GTCS) apply, without restriction or reservation, to all sales made through the website operated under the Albertine Atelier brand to individual consumers (B2C).
By placing an order, the customer fully and unconditionally accepts these GTCS.
3. PRODUCTS
The products offered for sale are downloadable digital files.
They consist exclusively of sewing patterns in PDF format, intended to be printed by the customer.
No physical products are delivered.
Each product includes:
- one or more PDF files,
- the sewing pattern,
- the French and English language versions, both provided with the purchase.
4. ORDERS
The customer places an order directly on the website via the WooCommerce platform.
Once an order has been confirmed, the customer is deemed to have firmly and definitively accepted the price and product description.
The seller reserves the right to refuse or cancel any order in the event of a previous dispute with the customer.
5. PRICES
Prices are displayed:
- in euros (EUR)
- and, depending on the language version of the website, in US dollars (USD).
In accordance with the French micro-enterprise scheme:
VAT not applicable – Article 293 B of the French General Tax Code.
The applicable prices are those displayed at the time the order is placed.
6. PAYMENT
Payment is due immediately upon placing the order.
The following payment method is accepted:
- Credit or debit card via Stripe.
Transactions are secured by the payment service provider.
7. ACCESS TO DIGITAL FILES
Digital files are available:
- immediately after payment has been confirmed,
- via a download link provided on the website and/or by email.
Downloads are:
- available without time limit,
- unlimited in number.
In the event of a technical issue, the seller undertakes to resend the files to the customer without limitation.
8. RIGHT OF WITHDRAWAL
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for digital content supplied in a non-physical form where performance has begun with the consumer’s prior express consent and express waiver of the right of withdrawal.
By confirming the order, the customer:
- agrees to immediate access to the digital content,
- expressly acknowledges waiving the right of withdrawal.
No refund may be requested once the files have been downloaded.
9. INTELLECTUAL PROPERTY
All files sold remain the exclusive property of Ms GINDRE – Albertine Atelier.
Purchasing a pattern grants the customer:
- a strictly personal right of use,
- the right to sew items for personal use or as gifts,
- the right to sell finished items sewn using the pattern.
The following are strictly prohibited:
- reselling, sharing or distributing the pattern,
- reproducing the files in whole or in part,
- making the patterns available to others, whether free of charge or for payment,
- any use other than that expressly permitted.
10. LIABILITY
The patterns offered are sewing guides.
The customer remains solely responsible for:
- the choice of materials,
- the making of the items,
- the use of the finished items.
The seller cannot be held liable for any damage resulting from improper use of the files or incorrect interpretation of the instructions.
The products offered are under no circumstances medical devices or regulated products.
11. PERSONAL DATA
The personal data collected is necessary for processing orders.
It is neither sold nor transferred to third parties.
The customer has the right to access, rectify and delete their personal data in accordance with applicable regulations.
12. GOVERNING LAW
These GTCS are governed by French law.
Where the customer is a consumer residing in another country, this choice of law does not deprive the customer of any mandatory consumer protection provisions afforded to them under the laws of their country of residence, where applicable.
The French version of these GTCS shall be the reference version. The English version is provided as a translation to facilitate understanding.
13. DISPUTE RESOLUTION – MEDIATION
In accordance with Articles L612-1 et seq. of the French Consumer Code, the customer may use a consumer mediator free of charge in order to seek an amicable resolution of a dispute.
The contact details of the competent mediator will be provided to the customer upon request.
If no amicable resolution can be reached, the dispute will be brought before the competent French courts.
14. AMENDMENTS TO THE GTCS
The seller reserves the right to amend these GTCS at any time.
The applicable GTCS are those in force on the date the order is placed.
